1. The following terms and conditions of sale define the rules for fulfilling orders and selling products available on the website www.dulcedeamor.com. All products offered in the dulcedeamor.com shop are sold directly by Aleksandra Kądziołka, who runs a registered business under the name: ‘Aleksandra Kądziołka Distribution’, with its permanent place of business in Czernichów 32-070, ul. Parkowa 27, Poland REGON 543025784, NIP 9442297585.

1.1. The seller or AK Distribution – Aleksandra Kądziołka, running a business under the name “Aleksandra Kądziołka Distribution”, with a permanent place of business in Czernichów 32-070, ul. Parkowa 27, REGON 543025784, NIP 9442297585, contact: info.dulcedeamor@gmail.com, helpline: +48 [513210021]. 

1.2. Consumer – a person who does business with a company that's not directly related to their business or professional activity (according to Article 221  of the Civil Code).

1.3. Entrepreneur – a person, a company, and a legal entity as mentioned in Article 331 §1 of the Civil Code, running a business on their own behalf.

1.4. Customer – a person or entity making purchases through the Shop.

1.5. General Terms and Conditions of Sale or GTCS – these ‘General Terms and Conditions of Sale’.

1.6. Privacy Policy – a document available on the Website, containing information on the processing of personal data and the use of cookies and similar technologies within the Shop and the Website.

1.7. Website – the website at www.dulcedeamor.com, on which AK Distribution operates the Shop. The Website is accessible both on computers and on mobile devices such as smartphones and tablets. 

1.8. Online Shop – the AK Distribution online shop accessible via the Website through which AK Distribution sells goods remotely.

2. Subject matter of the General Terms and Conditions of Sale and rules of sale 

2.1 AK Distribution sells products via the website www.dulcedeamor.com.

2.2. AK Distribution reserves the right to refuse to process or fulfil orders that do not comply with the terms and conditions of sale applicable on the website www.dulcedeamor.com.

2.3. These Terms and Conditions of Sale set out the rules for placing, accepting and fulfilling orders for products available on the website www.dulcedeamor.com, concluded between the Customer and the Seller.

3. Orders and invoices

3.1. Information about the range of goods displayed in the Shop does not constitute an offer within the meaning of Article 66 of the Civil Code, but an invitation to conclude a contract referred to in Article 71 of the Civil Code.

3.2. The prices of goods presented in the Online Shop are given in Polish zlotys (PLN) and are valid at the time of placing the order by the Customer.

3.3. The prices of goods presented in the Online Shop do not include delivery costs, which are added to the price of the ordered goods and shown separately when placing the order and on the sales document.

3.4. The prices of goods include applicable taxes, including value added tax (VAT) applicable on the date of placing the order. Any change in the VAT rate will be automatically included in the price of goods available in the Online Shop. 

3.5. In accordance with applicable law, the Seller issues a proof of purchase for each transaction (receipt or VAT invoice). If the Customer wishes to receive an VAT invoice for the purchased products, they should select the appropriate option when placing the order and provide the necessary details for its issuance.

3.6. By accepting the GTS and selecting the option to receive an invoice, the Customer agrees to the issuance and delivery of an electronic invoice, including any corrections or duplicates, to the email address provided in the order. If the Customer does not consent or withdraws their consent to receive electronic invoices, they are requested to contact customer@dulcedeamor.com, indicating the postal address to which the document should be sent in paper form.

3.7.  In situations where technical or formal obstacles prevent the sending of an electronic invoice, the Seller may issue a paper sales document.

3.8.  The online shop sells new products by post, free from physical and legal defects.

3.9.  Before placing an order, the Customer has the opportunity to familiarise themselves with the description, main features and properties of the product.

3.10.  Orders are placed by correctly completing the order form available in the Shop. The individual steps for placing an order and technical instructions are visible on the website during the purchasing process.

3.11.  After correctly placing an order, the Customer receives confirmation of order acceptance by e-mail. 

3.12.  Orders may be placed both by Customers who have an account in the Online Shop and by unregistered Customers who complete the order form, providing the details necessary for its completion. 

3.13.  By placing an order, the Customer declares that they have full legal capacity and may incur obligations arising from the order and these General Terms and Conditions of Sale. 

3.14.  Each order requires confirmation that the Customer has read the GTC and the Privacy and Cookie Policy available on the Shop's website.

3.15.  By clicking on the ‘Order with obligation to pay’ button, you place an order in accordance with the contents of your basket (product, price, quantity, delivery method) and confirm that you are aware of your obligation to pay regardless of the chosen payment method.

3.16. Placing an order constitutes an offer to conclude a sales contract between the Customer and the Seller. The offer is binding on the Customer until it is revoked or rejected by the Seller, in accordance with the rules set out in these GTC. 

3.17.  After accepting the order for completion, the Seller sends the Customer an order confirmation by e-mail. This confirmation constitutes the conclusion of a sales contract and also constitutes confirmation of the conclusion of a contract concluded at a distance within the meaning of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2025, item 1172, as amended; original: Dz. U. z 2025 r. poz. 1172 z późn. zm.).

3.18.  The Seller may suspend the order if the details provided by the Customer are incomplete or incorrect. In such a case, the Seller will attempt to contact the Customer by telephone or email in order to obtain the missing details. If contact cannot be established within 3 days for reasons beyond the Seller's influence, the order will be cancelled and any payments made will be refunded to the Customer.

3.19. The Seller is bound by the offer for 3 days. The shop may cancel the order if it is not paid fully within 3 days of its placement. In such a situation, the Customer will receive a notification of the cancellation of the order and a refund of any funds paid.

3.20.  The Customer has the right to withdraw from the sales agreement in accordance with the rules described in the section entitled ‘Withdrawal from the agreement’. 

3.21.  The Customer is obliged to provide correct and up-to-date contact details (e-mail address, telephone number, delivery address). The Seller shall not be responsible for delays or failure to fulfil the order resulting from the provision of incorrect or outdated details.

4. Order cancellation

4.1. If the ordered goods are unavailable, the order will be cancelled regardless of whether the Customer has submitted a declaration of offer.

4.2. As a result of the cancellation of the Order, the Customer's account will not be charged for the order, and if payment for the order has already been made, it will be refunded to the Customer immediately. 

5. Product warranty. Product prices.

5.1. The main features of each product are presented on the Website in the description of the product.

5.2. Product prices are subject to change. Before placing an order, it is important to check the current price applicable at the time of finalising the purchase.

5.3. Orders are fulfilled within the territory of the Republic of Poland. Orders placed from countries or addresses to which the Seller does not deliver will be automatically cancelled. 

6. Payments

6.1. Payment for the ordered products and delivery costs shall be made according to the procedure specified in the order form. The Customer shall not be charged any additional fees beyond the amount indicated by the Seller for the selected payment method.

6.2. In the case of credit or debit card payments, all payment details (including card number and expiry date) are transmitted via a secure, encrypted connection to the institution handling the electronic payment, without the possibility of access by third parties. This data is not stored or used by the Seller, except for the purpose of processing transactions, refunding funds in the event of withdrawal from the contract, or in situations required by law (e.g. reporting abuse to the relevant authorities).

6.3. The Customer may make an online payment (prepayment) for the ordered Products directly when placing the Order, choosing one of the following methods:

6.3.1 Online payments - processed via payment systems accepted by the Seller:

  • PayU - operated by PayU S.A. with its registered office at ul. Grunwaldzka 186, 60-166 Poznań, NIP: 779-230-84-95,
  • BLIK - operated by Polski Standard Płatności Sp. z o.o. with its registered office at ul. Czerniakowska 87A, 00-718 Warsaw, NIP: 521-366-44-94,
  • PayPal - operated by PayPal (Europe) S.à r.l. et Cie, S.C.A. with its registered office at 22–24 Boulevard Royal, L-2449 Luxembourg, registered in the Luxembourg Commercial Register under number B118349.

6.3.2 Payment by payment card – The shop accepts payments by Visa and MasterCard (credit and debit cards), made exclusively through the online payment operators listed in section 5.3.1 above.

7. Discount codes

7.1. The Seller reserves the right to apply discount codes.

7.2. Discount codes are individual promotional codes that entitle to a discount on purchases made on the Website. 

8. Responsibility

8.1. The goods offered by the Seller comply with the requirements of Polish law.  

8.2. Information about the ingredients of cosmetic products provided on the Website is for informational purposes only and should not be considered as advice or recommendations regarding the use of products. If you have any doubts about how to use a particular cosmetic product, we recommend that you read the product label, contact our team or consult a medical specialist.

8.3.  By using this website, you acknowledge that all information available on www.dulcedeamor.com, including expert-developed content, is for general educational purposes only and does not replace professional medical advice. If you have any health concerns or skin reactions, please consult your doctor or a qualified specialist.

9. Delivery

9.1. Within Poland, the Seller provides free delivery for all orders over PLN 150.00 (one hundred and fifty) (after discount codes have been applied). For orders of a lower value, the delivery cost is calculated in accordance with the current price list visible when placing the order.

9.2. Products are delivered within the territory of the Republic of Poland. The current list of the countries to which deliveries are made is available on the Dulce de Amor shop website when placing an order.

9.3. The buyer selects their preferred delivery method from the available options when placing their order.

9.4. Deliveries are made via courier companies such as InPost, DPD or other carriers specified when selecting the delivery method.

9.5. The Seller shall not be liable for delivery from the moment the order is handed over to the courier company, including delays resulting from reasons beyond the Seller's control, in particular reasons attributable to courier companies, “force majeure” or incorrect address details provided by the Customer. 

9.6. Upon receipt of the parcel, the Customer is obliged to check its condition and contents. In the event of damage to the parcel or damage to the packaging, it is recommended that a report of damage should be prepared in the presence of the courier.

9.7. If the Customer fails to collect the parcel, resulting in its return to the sender, the Seller may charge the Customer for the costs of re-shipping.

9.8. Detailed information about delivery costs, available methods and estimated delivery times is presented on the website www.dulcedeamor.com before finalising the order.

10. Returns and Complaints

10.1. In accordance with applicable consumer protection regulations, the Customer has the right to withdraw from the sales contract and return products purchased on the website www.dulcedeamor.com without giving any reason and without incurring additional costs, within fourteen (14) days from the date of receipt of the order.

10.2. If the Customer wishes to exercise their right to withdraw from the contract, they are obliged to return the products to the Seller within fourteen (14) days of informing the Seller of their decision to withdraw from the purchase. The return should be made via a courier company or another form of shipping that ensures safe delivery.

10.3. In order to use the right of withdrawal, the Customer should submit an unequivocal statement of withdrawal from the contract – for example, by sending an e-mail to: customer@dulcedeamor.com or sending a written statement by post to the Seller's registered office. The Customer may (but is not required to) use the ready-made withdrawal form, which can be found here.

10.4. The right to withdraw from the contract does not apply in the cases specified in Article 38 of the Consumer Rights Act, including in particular:

10.4.1 with regard to products which, due to their nature, cannot be returned after opening the packaging for hygiene or health reasons (e.g. cosmetics, oils, lotions, creams, serums, scrubs, gels, emulsions, etc.), if the packaging has been opened after delivery.

10.5. The weight of the product is 100/102 g (one hundred/one hundred and two). If the product is not sealed or wrapped in foil, the Seller shall check its weight upon return. If the weight of the product indicates that it has been opened and partially used, the Seller has the right to refuse to accept the returned product, in which case the Customer is not entitled to a refund and the withdrawal from the contract is ineffective. Returned products must be intact, in their original, sealed packaging. The return of a product whose packaging has been opened or damaged after delivery will not result in the withdrawal from the contract being accepted. 

10.6. In accordance with consumer protection regulations, the Customer is liable for any reduction in the value of the product resulting from its use in a manner other than that necessary to determine its nature, characteristics or functioning. In the event of the return of used or damaged products, the Seller has the right to refuse to accept them or to refund the amount reduced by the loss in value of the product.

10.7. After receiving a valid statement of withdrawal from the contract, the Seller shall refund the Customer all payments made by them, including delivery costs, no later than within 14 working days from the date of receipt of the statement, depending on the form of payment used. The refund will be made using the same payment method that the Customer used for the purchase, unless the parties agree otherwise. The Seller shall not refund delivery costs exceeding the cost of the cheapest available form of delivery offered in the shop.

10.8. The Seller may withhold the refund until the returned goods are received or confirmation of their return is provided, whichever occurs first.

10.9. The Customer is obliged to return the product immediately, but no later than within 14 days of submitting the declaration of withdrawal from the contract, to the following address:

10.10. The costs of returning the product to the Seller shall be paid by the Customer. It is recommended that the parcel be properly secured and sent with proof of dispatch.

11. Refunds

11.1. In case of circumstances obliging the Seller to refund all or part of the amount due (e.g. overpayment, withdrawal from the contract, acceptance of a complaint), the refund shall be made no later than within 14 calendar days from the date on which the obligation to refund arose. The refund shall be made using the same payment method that the Customer used when placing the order, unless this method is not possible, in which case the funds shall be transferred to the bank account number provided by the Customer.

11.2. The Seller may verify the Customer's identity before refunding the funds. If a refund cannot be made because the Customer has not provided their bank account number or other required details, the refund period may be extended until such details are provided.

11.3. The Seller shall not be liable for delays or failure to refund payments if they result from the Customer providing incorrect personal details, an incorrect bank account number or failure to respond to a request to provide such details.

11.4. All refunds are made exclusively in non-cash form – by bank transfer or refund to the account assigned to the payment method used.

12. Complaints Policy

12.1. The Customer has the right to submit a complaint regarding defects in the purchased product, its non-compliance with the contract, or errors in the order fulfilment. The complaint may concern, in particular:

12.1.1 receiving a damaged product,

12.1.2 receiving a product that does not comply with the order (e.g. a different variant, fragrance, capacity),

12.1.3 quantitative deficiencies in the shipment,

12.1.4 manufacturing defects in the product revealed after delivery.

12.2. Complaints may be submitted:

12.3. The customer may (but is not obliged to) use the ready-made withdrawal form, which can be found here.

12.4. Complaints are processed within 14 working days of receipt. The Customer will be informed of the Seller's decision by email.

12.5. If the complaint is accepted, the Seller undertakes, depending on the nature of the complaint, to:

12.5.1. replacement of the product with a new, defect-free product,

12.5.2. or a full refund of the product's value, including delivery costs, if delivery of a defect-free product is not possible. 

12.6. In case the complaint requires returning the product to the Seller, the Customer shall be obliged to send the product back to the following address:

12.7. The product should be returned in packaging that protects it from damage during transport.

12.8. The Seller shall not be liable for product defects resulting from improper use, storage contrary to recommendations, or mechanical damage caused by the Customer.

12.9. If the complaint is rejected, the Seller shall inform the Customer of the reasons for the rejection and the possibilities for further action, including seeking assistance from the municipal or district consumer ombudsman.

13. Complaints related to order delivery 

13.1. The Customer or recipient of the Order should inspect the condition of the parcel and goods upon delivery.

13.2. In the event of a damaged shipment or missing contents, or in the event of failure to deliver the ordered goods or finding quantitative deficiencies in the shipment, the Customer or the person receiving the order should request that a special report or statement confirming the damage or missing items be drawn up in the presence of the delivery person, in accordance with the procedures applied by the post office or courier company responsible for the delivery.

13.3. Complaints regarding delivery inadequacies may be submitted to the entity providing postal or courier (transport) services.

13.4. The Seller shall not be liable for damage to the Order after it has been handed over to the carrier.

14. Amendment to the General Terms and Conditions of Sale

14.1. The Seller reserves the right to amend the General Terms and Conditions of Sale for important reasons, such as, in particular, changes in regulations, the need to adapt the content of the General Terms and Conditions of Sale to decisions, decisions or recommendations of competent authorities and courts, expansion or modification of the Online Store, changes in technical conditions or the need to remove errors, as well as other circumstances that may prove significant from the point of view of the functioning of the Online Store.  

14.2. The Seller shall notify of any changes to the General Terms and Conditions of Sale by means of a notice posted in the Online Shop. The amended General Terms and Conditions of Sale shall also be made available (including for download in PDF format) in the Online Shop.

14.3. The amendment to the General Terms and Conditions of Sale does not affect orders placed prior to such amendment.

15. Final Provisions

15.1. The sale of goods in the Online Shop is subject to Polish law.

15.2. The Seller does not use alternative dispute resolution methods and does not undertake to use such methods unless required to do so by generally applicable Polish law.  

15.3. The Seller informs that the Customer who is a Consumer may obtain free assistance in the event of a dispute between such Customer and the Seller by contacting the district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection.

15.4. The Seller's liability for damage suffered by a Customer who is not a Consumer in connection with placing an order in the Online Shop, regardless of the basis for such liability, shall be limited to the maximum extent permitted by law to the amount paid by that Customer in connection with placing the order.

15.5. The regulations come into force on [26-11-2025].
